Please note that the withdrawal only takes effect for the future. Processing carried out before the withdrawal remains unaffected. Please also note that we may be required to retain certain data for a specific period in order to comply with legal obligations.

(2) Information About Your Right to Object Pursuant to Article 21 GDPR

1. RIGHT TO OBJECT ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION

You have the right, on grounds relating to your particular situation, to object at any time to the processing of personal data concerning you which is carried out on the basis of Art. 6 (1) lit. e GDPR (data processing in the public interest) and Art. 6 (1) lit. f GDPR (data processing based on a balancing of interests); this also applies to profiling based on these provisions within the meaning of Article 4 No. 4 GDPR.

If you object, we will no longer process your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or unless the processing serves the establishment, exercise or defence of legal claims (objection pursuant to Art. 21 (1) GDPR).

2. RIGHT TO OBJECT TO PROCESSING FOR DIRECT MARKETING PURPOSES

In individual cases, we process your personal data for direct marketing purposes. You have the right to object at any time to the processing of personal data concerning you for such marketing purposes.

If you object to processing for direct marketing purposes, we will no longer process your personal data for these purposes. The objection may be submitted informally and should preferably be addressed to the contact details specified under §1 No. (2) (objection pursuant to Art. 21 (2) GDPR).

(3) Wer bekommt meine Daten?

SUnless otherwise stated in the detailed descriptions of the respective services, access to your data within our company is granted only to those departments that require it for the fulfilment of our contractual and legal obligations or for the implementation of our legitimate interests.

We will only disclose information about you outside our company if statutory or official disclosure obligations permit or require such disclosure, if the disclosure is necessary for the execution and therefore fulfilment of the contract or, at your request, for the implementation of pre-contractual measures, if you have given your consent, or if we are authorised to provide information.

If we engage service providers for individual functions of our services, they are carefully selected and commissioned by us, are bound by our instructions and are regularly monitored. Your personal data is then processed on the basis of data processing agreements pursuant to Art. 28 GDPR and we ensure that the processing of personal data is carried out in accordance with the provisions of the GDPR.

Should we wish to use your data for advertising purposes, we will inform you in detail about the respective procedures below.

(4) How Long Will My Data Be Stored?

Unless otherwise specified in the detailed descriptions of the respective services, we process and store your personal data for as long as necessary to fulfil our contractual and legal obligations.

Your personal data will regularly be deleted or blocked when it is no longer required for the fulfilment of contractual or legal obligations, when you have exercised your right to deletion, when all mutual claims have been satisfied, and when no other statutory retention obligations or legal grounds for storage exist.

§ 3 Collection of Personal Data When Visiting Our Website

(1) Use of Server Log Files

Each time the website is accessed by a data subject or an automated system, a series of general data and information is collected in log files. This includes an Internet Protocol address (IP address), the browser types and versions used, the website from which an accessing system reaches our website (so-called referrer), the subpages accessed via an accessing system on our website, the date and time of access to the website, and other similar data and information used for protection against threats in the event of attacks on our information technology systems.

The legal basis for the temporary storage of data and log files is Art. 6 (1) lit. f GDPR in conjunction with the legitimate interests stated above.

Temporary storage of the IP address by the system is necessary to enable delivery of the website to the user's computer. For this purpose, the user's IP address must remain stored for the duration of the session.

Storage in log files takes place to ensure the functionality of the website. Furthermore, the data serves us to optimize the website and to ensure the security of our information technology systems. Our legitimate interest in data processing pursuant to Art. 6 (1) lit. f GDPR also applies here.

The data is deleted as soon as it is no longer required for the purpose for which it was collected. In the case of data collection for providing the website, this is the case when the respective session has ended.

The collection of data for providing the website and the storage of data in log files are necessary for the operation of the website.

A further possibility of reviewing the log files exists if, based on specific indications, there is a justified suspicion of unlawful use or a specific attack on our website. Our legitimate interest in processing here lies in the investigation and criminal prosecution of such attacks and unlawful uses.

(2) Use of Cookies

"Cookies" are small files that are stored on users' devices. They are either stored temporarily for the duration of a session (session cookies) or permanently (persistent cookies) on your device. Session cookies are automatically deleted after the end of your visit. Persistent cookies remain stored on your device until you delete them yourself or until they are automatically deleted by your web browser.

Cookies can store various types of information. Such information may include, for example, language settings on a website or the point at which a video was watched.

As a rule, cookies are also used when a user's interests or behaviour (e.g. viewing certain content, using functions, etc.) are stored in a user profile across individual websites. Such profiles are used, for example, to display content to users that corresponds to their potential interests. This procedure is also referred to as "tracking", i.e. tracking the potential interests of users.

The term cookies also includes other technologies that fulfil the same functions as cookies (e.g. where user information is stored using pseudonymous online identifiers, also referred to as "user IDs").

Insofar as we use cookies or tracking technologies, we will inform you separately in this Privacy Policy.

Information on Legal Bases: The legal basis on which we process your personal data with the help of cookies depends on whether we ask for your consent.

If this is the case and you consent to the use of cookies, the legal basis for processing your data is your declared consent (Art. 6 (1) lit. a GDPR).

Otherwise, the data processed with the help of cookies is processed on the basis of our legitimate interests (Art. 6 (1) lit. f GDPR), for example in the economically efficient operation of our online offering and its improvement, or, where the use of cookies is necessary to fulfil our contractual obligations, on the basis of Art. 6 (1) lit. b GDPR.

General Information on Withdrawal and Objection (Opt-Out): Regardless of whether processing is based on consent or legal permission, you have the possibility at any time to withdraw consent already given or to object to the processing of your data by cookie technologies (collectively referred to as "opt-out").

You may initially declare your objection via your browser settings, for example by disabling the use of cookies (although this may also restrict the functionality of our online offering).

Processing of Cookie Data on the Basis of Consent:

Before we process or have data processed in connection with the use of cookies, we ask users for consent that can be revoked at any time.

Before consent has been given, only cookies that are necessary for the operation of our online offering will be used. Their use is based on our interest and the interest of users in the expected functionality of our online offering.

Cookie Settings / Right to Object:

Cookies verhindern

You can prevent the installation of cookies by deleting existing cookies and disabling the storage of cookies in your web browser settings. Please note that in this case you may not be able to use all functions of our website to their full extent. You can also prevent the collection of the aforementioned information by setting an opt-out cookie on one of the websites linked below:

Please note that this setting will be deleted if you delete your cookies. You can object to the collection and transmission of personal data or prevent the processing of this data by disabling the execution of JavaScript in your browser. Furthermore, you can prevent the execution of JavaScript code altogether by installing a JavaScript blocker (e.g. https://noscript.net/ or https://www.ghostery.com). Please note that in this case you may not be able to use all functions of our website to their full extent.

§ 4 Additional Functions and Services of Our Website

In addition to the purely informational use of our website, we offer various services that you may use if interested. To do so, you will generally need to provide additional personal data, which we use to provide the respective service and for which the data processing principles described above apply.

(1) Contact by E-Mail, Telephone or Fax

We offer you the possibility of contacting us by e-mail, telephone or fax. When using these communication channels, the personal data transmitted by the user (e.g. name, inquiry) is stored and processed. The data is used exclusively for further communication and for processing your request and will not be passed on to third parties without your consent.

The legal basis for processing data transmitted in the course of contacting us is Art. 6 (1) lit. f GDPR, based on our legitimate interest in effectively handling inquiries addressed to us.

If the contact is aimed at concluding a contract, the legal basis additionally includes the implementation of pre-contractual measures and, where applicable, the subsequent processing required for the performance of a contract pursuant to Art. 6 (1) lit. b GDPR.

Personal data processed by us in connection with a general inquiry via e-mail, telephone or fax will only be stored for as long as the respective correspondence continues. The conversation is considered terminated when it can be inferred from the circumstances that the matter in question has been conclusively clarified. Mandatory statutory provisions – in particular retention periods – remain unaffected.

In the event of contact by e-mail, you may object to the storage of your personal data at any time. In such a case, the conversation cannot be continued.

(2) Use of Contact Forms

Our website also provides contact forms that can be used for electronic communication. The data entered by the user is transmitted to us and stored. The legal basis for processing data when using the contact form is Art. 6 (1) lit. f GDPR. Our legitimate interest lies in the effective processing of inquiries submitted via the contact form.

If the contact is aimed at concluding a contract, the legal basis additionally includes the implementation of pre-contractual measures and, where applicable, the subsequent processing required for the performance of a contract pursuant to Art. 6 (1) lit. b GDPR.

Personal data processed by us in connection with a general inquiry via the contact form will only be stored for as long as the respective correspondence continues. The conversation is considered terminated when it can be inferred from the circumstances that the matter in question has been conclusively clarified. Mandatory statutory provisions – in particular retention periods – remain unaffected.

In the event of contacting us, you may object to the storage of your personal data at any time. In such a case, the conversation cannot be continued.

§ 5 Amendments to Our Privacy Policy

We reserve the right to amend this Privacy Policy so that it always complies with current legal requirements or to implement changes to our services in the Privacy Policy, for example when introducing new services. The new Privacy Policy shall then apply to your subsequent visits.
